CHRISTIAN PHELPS: DUI charges are unique. Unlike other charges, which require some sort of intent, a DUI requires no intent. Nobody intends to get a DUI. Nonetheless, if you get one, you're facing serious penalties, including mandatory jail, mandatory license suspension.

In a DUI case, there are some very important timelines and some of them much shorter than others. The state will attempt to suspend your license just for getting charged with a DUI. You have a certain amount of time to request an administrative hearing to challenge that. If you miss that deadline, your license will be suspended.

In a DUI case, one of the first things to look at is whether or not the officer had sufficient probable cause to pull you over in the first place and then after that whether he developed sufficient evidence to establish that you were drinking and that drinking had impaired your ability to drive.

DUI laws vary from state to state. Oregon, Idaho, and Washington all have separate DUI laws with separate penalties and separate procedures. There's many things you can do in certain states to prevent or minimize some of your exposure that's not available in other states.
